IKYU.com Terms of Use
Date of Establishment: March 13, 2025 (Japan Standard Time)
"IKYU.com" is a service provided by IKYU Corporation (hereinafter referred to as "IKYU") that allows users to make reservations for hotels, ryokans, and other properties (hereinafter referred to as the "Service", and the site through which the Service is provided is referred to as the "Service Site").
Article 1 (Scope of Application)
This IKYU.com Terms of Use (hereinafter referred to as "These Terms") apply to all users of the Service (regardless of whether they are registered members who have agreed to the IKYU.com Membership Terms set by IKYU or not. The same applies hereinafter). Users are deemed to have agreed to These Terms by using the Service and are obligated to comply with These Terms in good faith.
Article 2 (Contents of the Service)
- 1. Users can utilize the services specified in the following items as part of the Service. There are no usage fees or other costs (excluding communication fees for devices used by users) for using the Service.
- (1) Search and collect information on properties such as hotels and ryokans registered in this Service (hereinafter simply referred to as "Properties").
- (2) Make reservations for Properties.
- (3) Cancel reservations and change reservation details for Properties.
- 2. In the case of a guest reservation (a reservation for a Property made without logging in as a member using a member ID issued based on the IKYU.com Membership Terms set by IKYU), a reservation number and authentication code notified by IKYU at the time of reservation are required to use the Service in item (3) of the preceding paragraph. Users are responsible for managing the reservation number and authentication code, and IKYU assumes no responsibility for any damages incurred by users due to third-party use of these.
- 3. The contents and specifications of this Service may be changed without prior notice.
Article 3 (Conclusion of Arranged Tour Contract)
- 1. When users apply for a reservation of a Property using this Service, users will conclude an arranged tour contract with IKYU (a contract in which IKYU undertakes to arrange for the use of services provided by the Property on behalf of the user by mediating at the user's request. The same applies hereinafter). No deposit is required for the conclusion of the arranged tour contract.
- 2. The arranged tour contract is concluded when the user applies for a reservation by agreeing to the application contents displayed on the reservation application page of this Service Site (hereinafter referred to as "Reservation Application Page"), IKYU's travel agency terms (arranged tour contract), These Terms, and other matters, and IKYU accepts the reservation application (when it is displayed on this Service Site that the reservation is complete for the user).
- 3. Regarding the conclusion of the arranged tour contract, IKYU will provide the information that should be stated in the transaction condition explanation document stipulated in Article 12-4, Paragraph 2 of the Travel Agency Act and the contract content document stipulated in Article 12-5, Paragraph 1 of the same law by posting it on the designated page of this Service Site instead of delivering these documents, and users shall agree to this in advance.
Article 4 (Payment of Accommodation Fee)
- 1. Users shall pay the accommodation fee for the Property reserved using this Service (the fee displayed as "payment amount" on the Reservation Application Page. The same applies hereinafter) to the Property by one of the following methods. Depending on the reserved Property (or individual accommodation plan of the Property), the payment method may be limited to one of the following.
- (1) Pay directly to the Property at the time of use (hereinafter referred to as "Local Payment").
- (2) Pay at the time of reservation on this Service Site using a credit card or other cashless payment method (hereinafter referred to as "Credit Card, etc.") (hereinafter referred to as "Advance Payment").
- 2. Items not included in the accommodation fee as stated on the Reservation Application Page (such as bathing tax, accommodation tax, and charges for food, beverages, and services ordered separately at the Property) shall be paid directly to the Property, regardless of the payment method in the preceding paragraph.
- 3. The Credit Card, etc., that can be used for Advance Payment is limited to those in the user's name, and users shall not use another person's Credit Card, etc., input false credit card information, or engage in other fraudulent acts. If users engage in fraudulent acts, IKYU may seek compensation for damages incurred.
- 4. If the card company, etc., refuses the use of the Credit Card, etc., used for Advance Payment for any reason, or if IKYU determines that it falls under fraudulent acts in the preceding paragraph, IKYU may change the payment method, cancel the reservation, or take other necessary measures without obtaining the user's consent. In this case, IKYU assumes no responsibility for any damages incurred by the user.
Article 5 (Cancellation of Reservation)
- 1. If users wish to cancel a reservation for a Property after it has been established using this Service, users shall perform the cancellation procedure using this Service or by directly contacting the Property. Note that the deadline for accepting cancellation procedures varies depending on the reserved Property (or individual accommodation plan of the Property), so please be careful.
- 2. When the cancellation procedure is performed based on the preceding paragraph, users shall pay the cancellation fee to the Property based on the cancellation policy posted on this Service Site. The same applies if users do not use the Property according to the reservation without performing the cancellation procedure based on the preceding paragraph (hereinafter referred to as "No-Show"). Except as provided in the following paragraph, IKYU is not involved in the payment of cancellation fees to the Property.
- 3. If a Cancellation Fee is incurred for a reservation with Advance Payment, our company will charge the equivalent amount to the credit card or other payment method used for Advance Payment on behalf of the property. If the card company declines the payment for any reason, users must transfer the equivalent amount in Japanese yen to a bank account designated by our company (transfer fees are borne by the user).
- 4. If the timing of the cancellation procedure results in our company charging an amount exceeding the actual Cancellation Fee, the excess amount will be refunded to the user in Japanese yen without delay. No interest will be added to the refunded amount.
Article 6 (Change of Reservation)
- 1. If users wish to change the details of a confirmed reservation, they must contact the property directly to complete the change procedure.
- 2. For reservations with Advance Payment, if the change results in a reduction of the accommodation fee, the fee after the reduction will be the amount charged. However, if the timing of the change results in the pre-reduction fee being charged, the difference will be refunded to the user in accordance with Article 5, Item 4.
- 3. If a change in reservation details involving an increase in the accommodation fee (such as an increase in the number of people or rooms, use of additional services, etc.) is made for a reservation with Advance Payment, users shall contact the Property directly to perform the change procedure and pay the increased amount directly to the Property. Note that the changed portion will not be treated as a reservation made using this Service.
- 4. If the change in reservation details results in a cancellation fee based on the cancellation policy posted on this Service Site, the payment of the cancellation fee shall be handled in accordance with paragraphs 2, 3, and 4 of the preceding article.
Article 7 (Precautions)
- 1. The availability and accommodation fees of Properties in this Service may differ from the information provided elsewhere by the Property.
- 2. The accommodation fees, etc., for Properties that can be reserved in this Service may change without notice. In this case, the changed accommodation fees, etc., will apply only to users who make reservations after the change, and users who have already made reservations will be subject to the accommodation fees, etc., at the time of reservation.
- 3. The information provided about Properties in this Service is provided under the responsibility of the Property, and IKYU assumes no responsibility for the accuracy, usefulness, comprehensiveness, or other aspects of the provided information.
- 4. Users shall confirm and comply with the accommodation terms, house rules, and other conditions related to the use of the Property as determined by the Property when using the Property.
Article 8 (Suspension or Interruption of Service)
- IKYU may suspend or interrupt the operation of this Service without prior notice to users in the following cases. In this case, IKYU assumes no responsibility for any damages incurred by users due to the suspension or interruption of the operation of this Service.
- (1) When regular or emergency maintenance of systems related to this Service is performed.
- (2) When the provision of this Service becomes impossible due to war, riots, disturbances, labor disputes, earthquakes, eruptions, floods, tsunamis, fires, power outages, or other emergencies.
- (3) When IKYU determines that a temporary interruption is necessary for the operation of this Service.
Article 9 (Disclaimer, etc.)
- 1. If the provision of this Service becomes impossible due to trouble with third parties such as providers or systems, IKYU assumes no responsibility.
- 2. If there is an error in the user's contact information, such as the email address registered by the user when using this Service, and the reservation completion or other communications related to the use of this Service do not reach the user, IKYU assumes no responsibility for any damages arising from this.
- 3. In addition to the cases specified in the preceding two paragraphs, IKYU assumes no responsibility for any damages incurred by users related to the use of this Service, except for damages attributable to IKYU.
Article 10 (Prohibited Acts)
- 1. When using this Service, users shall not engage in the acts specified in the following items.
- (1) Acts that violate or may violate laws and regulations.
- (2) Acts that are contrary to public order and morals or may be contrary to them.
- (3) Acts that infringe or may infringe the intellectual property rights or other rights of other users, third parties, or IKYU.
- (4) Acts that infringe or may infringe the property or privacy of other users, third parties, or IKYU.
- (5) Acts for profit-making purposes or preparatory acts for such purposes conducted through or related to this Service without IKYU's consent.
- (6) Acts of fraudulently reserving properties or reserving properties with false information.
- (7) Acts of making reservations that are recognized as impossible to use the Property as reserved, such as reserving multiple Properties for the same schedule.
- (8) Acts that cause or may cause disadvantages or damages to IKYU or Properties, such as No-Shows or not paying cancellation fees based on the cancellation policy set by the Property.
- (9) Acts of using or providing harmful programs such as computer viruses through or related to this Service.
- (10) Other acts that IKYU deems inappropriate.
- 2. If any of the acts in the preceding paragraph are recognized, IKYU may take necessary measures such as canceling Property reservations without any notice. In this case, IKYU assumes no responsibility for any damages incurred by users due to these measures.
- 3. Users shall exercise the utmost care not to cause damages to IKYU, Properties, or other third parties, and if users cause damages to these parties, users shall bear all legal responsibilities.
Article 11 (Environmental Settings When Using This Service)
Users shall appropriately set general character display and other settings such as email when using this Service. If the settings are not general, IKYU assumes no responsibility for the results of operations or the various effects they may have. The same applies if this Service does not operate correctly due to the user's OS, LAN environment, or device circumstances.
Article 12 (Handling of Personal Information)
IKYU shall handle users' personal information in accordance with the separately stipulated
personal information protection policy, and users agree to this.
Article 13 (Exclusion of Anti-Social Forces)
- 1. Users cannot use this Service if users fall under any of the following items. If it is discovered that users fall under any of these items, IKYU may take necessary measures such as deleting membership registration or canceling Property reservations without any notice.
- (1) (1) When recognized as belonging to anti-social forces such as organized crime groups, organized crime group members, quasi-members of organized crime groups, organized crime group affiliates, corporate racketeers, or other anti-social forces (hereinafter collectively referred to as "Anti-Social Forces").
- (2) When recognized as having Anti-Social Forces substantially involved in management.
- (3) When recognized as using Anti-Social Forces.
- (4) When recognized as providing funds or convenience to Anti-Social Forces.
- (5) When having a socially condemnable relationship with Anti-Social Forces.
- (6) When using deception, violent acts, or threatening behavior by oneself or through a third party.
- 2. If necessary measures are taken by IKYU based on the provisions of the preceding paragraph, IKYU assumes no responsibility for any damages incurred by users.
Article 14 (Jurisdiction)
Disputes between users and IKYU related to These Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court or the Tokyo Summary Court as the court of first instance.
Article 15 (Sincere Consultation)
If matters not stipulated in These Terms arise or if there is any doubt about the interpretation of These Terms, users and IKYU shall resolve them through sincere consultation.
Article 16 (Changes and Updates to These Terms)
IKYU may revise These Terms at any time. The revised terms shall take effect when posted on IKYU's website and shall apply to users.
These Terms is made in Japanese and translated into English. The Japanese text is the original and the English text is for reference purposes. If there is any conflict or inconsistency between these two texts, the Japanese text shall prevail.
